Marital Agreements
An Arizona prenuptial agreement must be in writing and signed by both parties, and it takes effect when they marry. A court may refuse to enforce an agreement that was not signed voluntarily, or one that was unconscionable when signed without fair disclosure of the other party’s finances. Postnuptial agreements, made during the marriage, are also reviewed for fairness and full disclosure.
Guardianship
A guardianship gives an adult, often a grandparent or other relative, legal authority to care for a child when the parents cannot. The court must appoint the guardian and can set limits on the guardian’s authority.
